1. Introduction

Welcome to Chicken Road! These Terms of Service ("Terms") govern your access to and use of the Chicken Road mobile application, including any content, functionality, and services offered on or through the application (the "Service"). By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Chicken Road is a skill-based mobile game that challenges players to navigate various obstacles without any gambling elements. Our game is designed to be enjoyed by players of all ages.

2. Eligibility

The Service is available to users of all ages. However, if you are under the age of 13, you should review these Terms with your parent or guardian to ensure that you both understand them. By using the Service, you represent and warrant that you meet all eligibility requirements that we outline in these Terms.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. It is your responsibility to safeguard your account information and to supervise and take responsibility for any use of your account by others. We reserve the right to disable any user account at any time if, in our opinion, you have failed to comply with any provision of these Terms.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password.

4. User Content

Our Service may allow you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("User Content"). You are responsible for the User Content that you post on or through the Service, including its legality, reliability, and appropriateness.

By posting User Content on or through the Service, you represent and warrant that: (i) the User Content is yours or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) that the posting of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Chicken Road and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Chicken Road.

You acknowledge that all intellectual property rights, including copyrights, patents, trademarks, and trade secrets, in the Service and its content are owned by us or our suppliers. Neither these Terms nor your access to the Service transfers to you any rights, title, or interest in or to such intellectual property rights.

6. Prohibited Uses

You may use our Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter", "spam", or any other similar solicitation.
• To impersonate or attempt to impersonate Chicken Road, a Chicken Road employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm Chicken Road or users of the Service.
• To attempt to circumvent any security measures implemented within the application.

7. In-App Purchases and Virtual Currency

The Service may include virtual currency ("Coins") as well as certain features and content that can be purchased with real money. Any purchase of such virtual items is final and non-refundable. Virtual items have no monetary value and cannot be redeemed for cash or any other physical item. You do not own virtual items; rather, you obtain a limited, personal, revocable, non-transferable license to use such virtual items.

We reserve the right to control, regulate, change, or remove any virtual items without any liability to you. The price and availability of virtual items are subject to change without notice.

8. Updates and Changes to the Service

We may update the content on this Service from time to time, but its content is not necessarily complete or up-to-date. We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Chicken Road expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that (i) the Service will meet your requirements, (ii) the Service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the Service will be accurate or reliable, or (iv) any errors in the Service will be corrected.

10. Limitation of Liability

In no event shall Chicken Road, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

11. Indemnification

You agree to defend, indemnify, and hold harmless Chicken Road, its parent company, officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
